Lattimore Law Wins Motion to Dismiss Copyright Infringement Lawsuit

Phoenix, AZ (February 9, 2025): The United States District Court for the District of Arizona has granted SinSaint, Inc.’s motion to dismiss the copyright infringement lawsuit filed against it by Bad Dragon Enterprises, Inc.

Bad Dragon, which is located in Arizona, alleged that SinSaint, a New York corporation, infringed its copyrights by marketing and selling products that directly copied the sculptural design elements of Bad Dragon’s products. The complaint, filed on March 20, 2024, alleged thirteen counts of infringement under the Copyright Act.

SinSaint filed its Motion to Dismiss on August 14, 2024, citing lack of personal jurisdiction and improper venue. In opposing the motion, Bad Dragon argued that SinSaint offered infringing products for sale to Arizona residents through its website after receiving a cease-and-desist letter from Bad Dragon and thereby aimed its alleged infringement at the forum. Bad Dragon further argued that SinSaint registered its website with Arizona domain registrar GoDaddy.com and, in doing so, subjected itself to the Court’s jurisdiction. The Court rejected Bad Dragon’s arguments in their entirety.

The Court also denied Bad Dragon’s request for jurisdictional discovery. The Court determined that Bad Dragon’s basis for seeking jurisdictional discovery was purely speculative and that Bad Dragon sought what amounted to a “fishing expedition for jurisdictional facts.”   SinSaint was represented in the lawsuit by New Jersey intellectual property attorney Jason B. Lattimore, with Nancy R. Giles serving as valued local Arizona counsel.
