Disputes regarding trademark rights can have serious ramifications for those involved.  Mr. Lattimore has been handling trademark matters for clients for fourteen years, and it is the primary focus of his practice. Mr. Lattimore is adept at handling the issues that arise in cases involving trademark infringement claims, as well as claims of false advertising, trade dress infringement, trademark counterfeiting, common law and state unfair competition, and claims arising under the Anticybersquatting Consumer Protection Act.  He has obtained numerous positive outcomes for both plaintiffs and defendants in trademark litigation.

Mr. Lattimore also counsels clients regarding trademark selection, and handles trademark clearance and filings.  He is experienced with the evaluation of trademarks both in connection with the selection of a mark for registration, and in the context of litigation.

  • Represented the defendant, a New Jersey spa, in this dispute over the use of the trademark “Lush.”     

Entrepreneur Media, Inc. v. Gray et al., Case No. 2:12-cv-1346 (D.N.J. 2012)

  • Represented the plaintiff in trademark litigation concerning the mark “Entrepreneur.”  [Handled at a prior firm.]

Trident Group v. Haddadin et al., Case No. 13-cv-7463 (D.N.J. 2013)

  • Represented the defendant, a California distributor, in a dispute over use of the trademark “HALO.” 

Sleep Innovations, Inc. v. Sinomax USA Inc. et al., Case No. 2:06-cv-5712 (C.D. Cal. 2006)

  • Represented the plaintiff, a foam bedding products manufacturer, in a suit involving claims for both trademark infringement and misappropriation of trade secrets.

  • Represented the plaintiff in trademark counterfeiting litigation.

  • Represented the plaintiff in trademark counterfeiting litigation.

Recent non-litigation matters:

  • Handled trademark clearance and filing for a consumer products manufacturer.
  • Handled trademark clearance for a book publisher and advised the publisher regarding the results of the clearance search and strength of the trademark.
  • Performed trademark clearance services for a start-up food company and advised the company regarding the results of the search.
  • Advised a product manufacturer regarding whether the content of its proposed advertising presented any risk of false advertising claims being brought against it.
